Terms of Service

Welcome to Tim Hunter CPA. By accessing or using this website, our digital tools, or our client portals, you agree to comply with and be bound by these Terms of Service. Please read them carefully; if you do not agree, you should not use this website or upload files to our servers. Tim Hunter CPA reserves the right to revise or update these Terms of Service at any time without prior notification, and continued use of the website following any changes constitutes acceptance of the updated terms. By engaging Tim Hunter CPA or submitting an onboarding form, Client acknowledges having read, understood, and agreed to be bound by these Terms of Service in their entirety.

The information provided on this website is intended for general informational and educational purposes only and does not constitute formal accounting, tax, legal, or investment advice. A formal accountant-client relationship is established only once Client has entered into a signed engagement letter or professional services contract with Tim Hunter CPA. A signed proposal and engagement letter are required prior to the commencement of any work, and Tim Hunter CPA endeavors to conduct engagements electronically for the convenience of all parties; in-person meetings are available by appointment only and must be scheduled in advance.

All bookkeeping, accounting, and tax preparation services are performed on the basis of unaudited information supplied by Client. Tim Hunter CPA does not perform examinations, audits, reviews, or any form of attestation with respect to information provided, and does not independently verify, audit, or attest to information supplied by Client. Client bears sole and exclusive responsibility for ensuring that all financial information, tax documents, ledgers, and other records submitted are true, accurate, and complete in all material respects, and free of false, fraudulent, or misleading content. Client is responsible for providing supporting explanations or source documents for any information used in the preparation of bookkeeping or tax records, for supplying all necessary documentation in a timely and organized manner, and for carefully reviewing all bookkeeping and tax documents prior to acceptance, signature, or filing. Tim Hunter CPA reserves the right to request additional documentation or clarification at its discretion and is not responsible for any tax penalties, interest, audit discrepancies, or financial errors resulting from inaccurate, fraudulent, or omitted documentation provided by Client.

Tax filing deadlines and overall tax compliance remain the ultimate and exclusive responsibility of the taxpayer. Any penalties, interest, or fees assessed by a federal, state, or local taxing authority are solely Client's responsibility to satisfy. While Tim Hunter CPA makes every reasonable effort to assist in mitigating such assessments, certain circumstances are beyond the firm's control, and Client agrees that Tim Hunter CPA shall not be held liable for any penalties or interest imposed for any reason. Should Client's returns or financial records become subject to audit, examination, or inquiry by a taxing authority, Client accepts full responsibility for cooperating with and responding to the proceeding, including providing all requested information and documentation. All penalties, fees, and professional fees incurred in connection with such proceedings, including any representation or assistance provided by Tim Hunter CPA, are Client's responsibility and will be billed at the firm's then-current hourly rate.

Tim Hunter CPA reserves the right to adjust its fees during the course of an engagement if the scope, complexity, or volume of work materially exceeds initial estimates; any such adjustment will be communicated to and discussed with Client in advance. A retainer may be required prior to the commencement of services, based on the estimated scope and time requirements of the engagement. Invoices are due and payable upon receipt and are generally issued on or around the last business day of each calendar month; any balance remaining unpaid beyond thirty days of the invoice date is subject to a finance charge at the rate permitted by applicable law. Recurring service fees may be automatically drafted on or before the twenty-seventh day of each month, with a paid invoice issued to Client upon processing. Checks tendered as payment may be processed electronically through Client's financial institution; if a check is returned unpaid for any reason, it may be re-presented electronically, and a returned check fee, in addition to any bank-assessed charges, may be added to the outstanding balance. By tendering payment or providing ACH information, Client affirms that they are authorized to use the payment method provided and consents to automatic drafting of open invoices from the designated personal or business account; if an ACH transaction or other payment method is returned or not authorized, Client authorizes Tim Hunter CPA to apply the outstanding balance to another payment method on file. All service fees, including prepaid fees, retainers, and subscription fees, are non-refundable once work has commenced.

Monthly subscription fees are reviewed each December, with any adjustment taking effect at the start of the January billing cycle; Client will be notified of a fee change no less than thirty days before it takes effect, and for clients enrolled for fewer than twelve months at the time of an increase, the adjustment will be prorated accordingly. Recurring fees are automatically drafted upon commencement of work or as billing occurs, and Client is required to provide valid banking information and consents to such drafts. Monthly bookkeeping subscriptions do not include year-end payroll filings or year-end close-out procedures unless explicitly enumerated in the signed proposal. For clients engaged for QuickBooks cleanup, setup, or ongoing monthly subscription services, all associated fees are non-refundable; the monthly subscription, if applicable, will commence no later than sixty days following the start of the cleanup or setup period; if Client does not provide required cooperation or support in a timely manner, monthly fees will continue to accrue and be applied toward costs incurred during any resulting extension; and the subscription includes ongoing access to Tim Hunter CPA throughout the subscription period as an integral part of the engaged services. Monthly services may be cancelled at any time by either party; however, all fees paid remain non-refundable. Legal and administrative services rendered by Tim Hunter CPA, including the preparation and submission of documents to third parties, are billed separately at the firm's then-current hourly rate, for which Client agrees to be responsible. Submission of the new client form constitutes Client's full agreement with and acceptance of these billing terms and all conditions set forth in the onboarding documentation, and by submitting the form Client affirms that they are an authorized signatory or otherwise authorized to approve charges to the payment method provided.

All file and document exchanges between Client and Tim Hunter CPA is conducted through Progress ShareFile, a secure, encrypted platform, as well as the QuickBooks Online portal and the firm's interactive online forms where applicable. Use of these secure portals is required for the transmission of sensitive financial and personal information. When using these portals, Client agrees to transmit only documents and files that belong to Client or that Client has the legal right to manage, to refrain from transmitting files containing malicious code, viruses, or spyware, and to maintain the confidentiality of Client's own account credentials and logins. Original documents furnished by Client will be returned following scanning and incorporation into the client file, and Tim Hunter CPA retains copies of all supporting documentation used in the preparation of financial reports and tax returns.

Tim Hunter CPA's Client Resource Center provides links to third-party portals and federal or state systems, including the Internal Revenue Service, the Georgia Department of Revenue, and services such as MileIQ and SecurityMetrics. Tim Hunter CPA does not operate, control, or accept legal liability for the functionality, uptime, or privacy standards of these external, governmental, or corporate third-party platforms.

The nature of our services requires the collection, processing, and retention of personal and financial information from Client and, where applicable, third-party sources. By accepting our services, Client authorizes Tim Hunter CPA to obtain and process such information as reasonably necessary to perform the engaged work. Tim Hunter CPA maintains comprehensive privacy policies and a data protection plan to safeguard Client information and will not disclose Client information to any third party except as required by applicable law or regulatory authority, or as expressly authorized by Client in writing. Additional detail regarding our data protection practices is available on our website. By executing an engagement agreement or submitting an onboarding form, Client also authorizes Tim Hunter CPA to communicate by email and/or SMS for firm announcements and general marketing communications; Client may opt out of such communications at any time.

To the maximum extent permitted by law, Tim Hunter CPA, its owners, and its employees shall not be liable for any indirect, incidental, or consequential damages resulting from Client's use of this website, gaps in unmanaged content, or Client's inability to access secure portals due to temporary internet disruptions. These Terms of Service are governed by and construed in accordance with the laws of the State of Georgia, without regard to conflict of law principles, and any legal disputes arising from use of this website shall be handled in the appropriate court system representing Southwest Georgia.

By engaging Tim Hunter CPA and/or submitting the onboarding form, Client acknowledges that they have read, understood, and agree to be bound by these Terms of Service in their entirety. Terms subject to change.
