Welcome to the website of Tim Hunter CPA. By accessing or using this website, our digital tools, or our client portals, you agree to comply with and be bound by the following Terms of Service. Please read these terms carefully. If you do not agree to these terms, you should not use this website or upload files to our servers.
1. Scope of Service & Website Intent
The information provided on this website is intended for general informational and educational purposes only. Website content does not constitute formal accounting, tax, legal, or investment advice. A formal accountant-client relationship is only established once you have entered into an explicitly signed engagement letter or professional services contract with Tim Hunter CPA.
2. Client Responsibility for Accurate Data
Our firm relies entirely on the accuracy, completeness, and truthfulness of the financial information, tax documents, ledgers, and metrics you provide. Tim Hunter CPA is not responsible for any tax penalties, interest, audit discrepancies, or financial errors resulting from inaccurate, fraudulent, or omitted documentation provided by the user or business owner.
3. Acceptable Use of Secure Portals
When utilizing our Progress ShareFile upload portal, the QuickBooks Online portal, or our interactive online forms, you agree to:
Transmit only documents and files that belong to you or that you have the explicit legal right to manage.
Refrain from transmitting files containing malicious code, viruses, or spyware designed to disrupt our technical infrastructure.
Maintain the confidentiality of your own account credentials and client logins.
4. Third-Party Links & Tools
Our Client Resource Center provides links to third-party portals and federal/state systems, including the Internal Revenue Service (IRS) and the Georgia Department of Revenue (DOR). Tim Hunter CPA does not operate, control, or accept legal liability for the functionality, uptime, or privacy standards of these external, governmental, or corporate third-party platforms (such as MileIQ or SecurityMetrics).
5. Limitation of Liability
To the maximum extent permitted by law, Tim Hunter CPA, its owners, and its employees shall not be liable for any indirect, incidental, or consequential damages resulting from your use of this website, information gaps in the unmanaged content, or your inability to access secure portals due to temporary internet disruptions.
6. Governing Law
These Terms of Service are governed by and construed in accordance with the laws of the State of Georgia, without regard to conflict of law principles. Any legal disputes arising from the use of this website shall be handled in the appropriate court system representing Southwest Georgia.
7. Modifications to Terms
Tim Hunter CPA reserves the right to revise or update these Terms of Service at any time without prior notification. Your continued use of the website following any changes signals your acceptance of the updated terms.
8. Billing & Payment Terms
All invoices are due and payable upon receipt. Any outstanding balance remaining unpaid beyond thirty (30) days from the invoice date shall be subject to a finance charge at the rate permitted by applicable law.
Checks tendered as payment may be processed electronically through your financial institution. In the event a check is returned unpaid for any reason, Client acknowledges and agrees that: (i) the check may be re-presented electronically; and (ii) a returned check fee, in addition to any bank- assessed charges, may be assessed and added to the outstanding balance.
Unless alternative billing arrangements have been mutually agreed upon in writing, invoices will be generated on or around the last business day of each calendar month. Recurring service fees may be automatically drafted on or before the 27th day of each month, and a paid invoice will be issued to Client upon processing.
A retainer may be required prior to the commencement of services, the amount of which shall be based upon the estimated scope and time requirements of the engagement. All service fees, including prepaid fees, retainers, and subscription fees, are non-refundable once work has commenced.
By tendering payment, Client affirms that they are authorized to use the payment method provided and consents to any applicable automatic drafting as set forth herein.
ACH (electronic payment information) that you provided will be used to process any outstanding balances. You hereby authorize such transfers to pay open invoices associated with your and/or your business. In the event one or more of your ACH or payment accounts returns or the transaction is not authorized, you authorize us to run the outstanding balance using another method you provided either for your personal account or your business account balances.
9. Client Representations & Responsibilities
Client represents, warrants, and affirms that all information provided in connection with any engagement — including, without limitation, all accounting and tax documentation — is true, accurate, and complete in all material respects, and that no false, fraudulent, or misleading information has been submitted.
Client acknowledges and accepts full responsibility for the accuracy and completeness of all financial reports and tax returns prepared by Tim Hunter CPA, as all such work product is prepared exclusively on the basis of information furnished by Client. Tim Hunter CPA does not independently verify, audit, or attest to information provided by Client.
By executing an engagement agreement or submitting this form, Client authorizes Tim Hunter CPA to communicate via email and/or SMS for purposes of firm announcements and general marketing communications. Client may opt out of such communications at any time.
10. Service Delivery
Tim Hunter CPA endeavors to conduct engagements electronically for the convenience of all parties. In-person meetings are available by appointment only and must be scheduled in advance. General Engagement Understanding
Please review this section carefully, as it defines the terms and responsibilities governing the bookkeeping and tax services for which Tim Hunter CPA has been engaged.
11. Scope of Services
All bookkeeping, accounting, and tax preparation services are performed on the basis of unaudited information supplied by Client. Tim Hunter CPA does not perform examinations, audits, reviews, or any form of attestation with respect to information provided. Client bears sole and exclusive responsibility for ensuring the accuracy, completeness, and truthfulness of all information submitted.
Tim Hunter CPA reserves the right to adjust its fees during the course of an engagement in the event that the scope, complexity, or volume of work materially exceeds initial estimates. Any proposed fee adjustment will be communicated to Client in advance and discussed prior to implementation.
Client agrees to provide all information and documentation necessary to complete the engaged services in a timely and organized manner and affirms that such information is accurate. Tim Hunter CPA reserves the right to request additional documentation or clarification at its discretion. Client is responsible for providing supporting explanations or source documents for any information used in the preparation of bookkeeping or tax records.
Client is strongly advised to carefully review all bookkeeping and tax documents prior to acceptance, signature, or filing.
12. Tax Compliance & Penalties
Tax filing deadlines and overall tax compliance remain the ultimate and exclusive responsibility of the taxpayer. Any penalties, interest, or fees assessed by any taxing authority — federal, state, or local — are solely the responsibility of the Client to satisfy. While Tim Hunter CPA makes every reasonable effort to assist in mitigating such assessments, certain circumstances are beyond the firm’s control. Accordingly, Client agrees that Tim Hunter CPA shall not be held liable for any penalties or interest imposed for any reason whatsoever.
13. Privacy & Data Protection
The nature of our services requires the collection, processing, and retention of personal and financial information from Client and, where applicable, third-party sources. By accepting our services, Client authorizes Tim Hunter CPA to obtain and process such information as reasonably necessary to perform the engaged work.
Tim Hunter CPA maintains comprehensive privacy policies and a data protection plan to safeguard Client information. We will not disclose any Client information to any third party except: (i) as required by applicable law or regulatory authority; or (ii) as expressly authorized by Client in writing. 14. Document Management & Engagement Requirements
All file and document sharing is conducted through ShareFile, a secure, encrypted platform that provides convenient and protected document exchange for both the firm and its clients. A signed proposal and engagement letter are required prior to the commencement of any work. Original documents furnished by Client will be returned following scanning and incorporation into the client file. Tim Hunter CPA retains copies of all supporting documentation used in the preparation of financial reports and tax returns.
15. Audits & Third-Party Reviews
Client acknowledges that from time to time, taxing authorities may subject Client’s returns or financial records to audit, examination, or inquiry. Client accepts full responsibility for cooperating with and responding to any such proceedings, including providing all information and documentation requested by the taxing authority. All associated penalties, fees, and professional fees incurred in connection with such proceedings — including representation and assistance by Tim Hunter CPA — are the sole responsibility of Client. Any such assistance provided by Tim Hunter CPA will be billed at the firm’s then-current hourly rate.
16. Additional Business Terms & Conditions
Subscription Fees & Adjustments
Monthly subscription fees are subject to periodic adjustment. Clients will be notified of any fee change no less than thirty (30) days prior to its effective date. Subscription fees are reviewed each December, with any applicable adjustments taking effect at the commencement of the January billing cycle. For clients enrolled in services for fewer than twelve (12) months at the time of a fee increase, the adjustment shall be prorated accordingly.
Recurring fees are automatically drafted upon commencement of work or as billing occurs. Client is required to provide valid banking information and hereby consents to such automatic drafts. All fees, including prepaid fees and deposits, are non-refundable once work has commenced. Monthly bookkeeping subscriptions do not include year-end payroll filings or year-end close-out procedures unless such services are explicitly enumerated in the signed proposal. Submission of the new client form constitutes Client’s full agreement with and acceptance of these Terms & Conditions and all conditions set forth in this onboarding documentation.
QuickBooks Services
Clients engaged for QuickBooks cleanup, setup, or ongoing monthly subscription services acknowledge and agree to the following:
- All associated fees are non-refundable;
- Monthly subscription fees will commence no later than sixty (60) days following the initiation of the cleanup or setup period (if subscribed);
- In the event that required Client cooperation or support is not provided in a timely manner, monthly fees will continue to accrue and be applied to cover costs incurred during any extension of the cleanup or setup period;
- A monthly subscription includes ongoing access to Tim Hunter CPA throughout the subscription period and is considered an integral component of the engaged services;
- Monthly services may be cancelled at any time by either party; however, all fees paid are non-refundable.
Legal, Administrative & Third-Party Fees
All legal and administrative services rendered by Tim Hunter CPA — including, without limitation, the preparation and submission of documents to third parties — are billed at the firm’s then-current hourly rate. Client agrees to be responsible for all such fees.
By submitting this form, Client affirms that they are an authorized signatory or otherwise authorized to authorize charges with respect to the payment method provided.
Secure File Sharing
All file and document exchange is conducted through Progress ShareFile, which provides a secure, encrypted platform for uploading, downloading, and accessing documents. Use of ShareFile is required for the transmission of all sensitive financial and personal information.
By engaging Tim Hunter CPA and/or submitting the onboarding form, Client acknowledges that they have read, understood, and agree to be bound by these Terms of Service in their entirety. Terms subject to change.
